GRC to launch Swiss project on increasing ratification of the Starvation amendment, as Liechtenstein deposits instrument of ratification

As Liechtenstein becomes the 7th State to ratify the Rome Statute amendment, extending the application of starvation as a war crime to non-international armed conflicts (NIAC), GRC is proud to announce that in 2022 it will support the International Law Directorate of the Swiss Federal Department of Foreign Affairs (FDFA) in increasing the ratification uptake of the Starvation amendment. From an initial proposal in the Working Group on Amendments of the Assembly of States Parties (ASP) in April 2018, up to the historic adoption of the Swiss proposal to include the war crime of intentionally starving the civilian population in non-international armed conflicts (NIAC) in December 2019, Switzerland has been a leading force in efforts to support and enhance the effectiveness of the International Criminal Court (ICC). GRC provided a range of support to the Swiss Federal Department of Foreign Affairs (FDFA) during Switzerland’s proposal to amend the Rome Statute of the ICC and was proud to witness the unanimous adoption of the amendment in December 2019, enabling the investigation and prosecution of the war crime of starvation in a NIAC for the first time. With the majority of starvation violations occurring in NIACs, the importance of this amendment cannot be overstated. To date, the Starvation amendment, whilst relatively recent, has been ratified by only 7 member states. To close this gap, GRC will engage with States Parties to the ICC and other interested stakeholders as they seek clarity for purposes of ratification and domestic implementation of the Amendment, offering them a comprehensive Guidebook and expert technical assistance on the details of the amendment and the procedural aspects of ratification. The project accordingly aims to raise awareness of the crime and its impact on the protection of civilians, to increase ratification and domestication of the Starvation amendment, to strengthen protections under ICL and, ultimately, to highlight non-international avenues for pursuing accountability for the use of starvation as a war crime. We urge all States Parties to the ICC to follow in their footsteps by ratifying and incorporating the Starvation amendment into their own domestic legislation without delay.
